Should You Sign an Exclusive Modeling Contract ?

By bobpardue

Here is a question I received about the different types of model contracts. Please read and offer your comments and suggestions, especially if you are a talent agent or experienced model.

Hi Bob,

Just wanted to thank you for the free model mini course

It is so nice to have infromation brought right to my email.

Have you ever considered doing one on questions to ask photographers or agents before you get involved with them.

We newbies just don’t know what to ask and believe me it is never volunteered to us.

Like contracts, copyright, exclusive, non exclusives, model releases etc.. These are still confusing to me.

It has been a pleasure,
Jana

Jana,

Thank you for sharing this with me. I’m glad that the mini-course is helping.

To answer your questions, contracts may not be standard throughout the industry so not sure if I want to tackle legal issues. Just ask a legal person if there are things in the contract you don’t understand.

Exclusive & non-exclusive is fairly simple. Exclusive means you are only allowed to work through that one agency while the latter allows you to work through several agencies at once.

Normally, the larger and more successful the agency (i.e. Ford of NYC) the more likely the agent will call for an exclusive contract. Just ask yourself if this agency is going places before signing an exclusive. Also, talk to some of their models to see how many assignments they are receiving.

Now, questions to ask a photographer. You can find many of these questions at ..

Just scroll to the middle of the page.

Questions for the agency? Still the main question is do they charge any fees besides commissions (some will offer to set up a portfolio shoot for you but many will let you choose your photographer).

Then, ask to talk to some of their models. You’ll find out more this way than listening to the model agency.

Hope this helps.

Best,
Bob
